The Palestinian Grassroots Anti-Apartheid Wall Campaign Demands that the UN
Enforce the ENTIRE ICJ Ruling Against the Apartheid Wall!

The UN has published a plan to install register offices in the West Bank to
list damages caused by the Apartheid Wall, in order to compensate the
Palestinian population. This was seemingly to "enforce" the decision of the
International Court of Justice (ICJ) regarding the illegality of the
Apartheid Wall, the settlement policy, and the Occupation. The ICJ did rule
for compensation, but called for this in parallel with international
pressure to force Israel into respect for international law. So what has
happened to this essential part of the ICJ ruling?

Here is the full list of articles in the original ICJ ruling:
ˇ          Israel is under an obligation to terminate its breaches of
international law; it is under an obligation to cease forthwith the works of
construction of the wall being built in the Occupied Palestinian Territory,
including in and around East Jerusalem, to dismantle forthwith the structure
therein situated, and to repeal or render ineffective forthwith all
legislative and regulatory acts relating thereto, in accordance with
paragraph 151 of this Opinion;
ˇ          Israel is under an obligation to make reparation for all damage
caused by the construction of the wall in the Occupied Palestinian
Territory, including in and around East Jerusalem;
ˇ          All States are under an obligation not to recognize the illegal
situation resulting from the construction of the wall and not to render aid
or assistance in maintaining the situation created by such construction; all
States parties to the Fourth Geneva Convention relative to the Protection of
Civilian Persons in Time of War of 12 August 1949 have in addition the
obligation, while respecting the United Nations Charter and international
law, to ensure compliance by Israel with international humanitarian law as
embodied in that Convention;
ˇ          The United Nations, and especially the General Assembly and the
Security Council, should consider what further action is required to bring
to an end the illegal situation resulting from the construction of the wall
and the associated régime, taking due account of the present Advisory
Opinion.

If it was truly serious about enforcing this decision in its entirety, as it
is obliged to do, the UN would begin to take steps forcing Israel to stop
the Wall and dismantle the completed parts. But rather than mobilizing the
pressure of the international community against Israel's violations of
international law, the UN is offering Palestinians nothing but another
relief office, similar to the one created for refugees after the 1948
Occupation. As in the case of the refugees, the UN reduces its role when it
comes to Palestinian rights to the "humanitarian" side-another step in
turning the Palestinian cause into a "humanitarian" case that can be
 "solved" with a dose of international aid. Once again, donor countries will
be the ones paying for Israel's violations of international law. This
approach ignores the fact that the Palestinian cause is a people's struggle
for their rights, and that the UN's role should not be merely about
providing food baskets and tents to those whose lives are destroyed by the
Occupation. Its role must be to defend international law by upholding the
rights of the Palestinian people.

What is clear is that as long as construction of the Apartheid Wall
continues, and as long as any completed part of the Wall still stands, these
proposed compensations will be transformed from being part of the ICJ's
decision into the decision itself. Compensation for damages cannot be the
starting point from which the UN will fully implement the ICJ's decision.
For the UN to start from the point that should be the last must be
understood as a recognition and acceptance of what the Occupation creates on
the ground, rather than an attempt to enforce the ICJ's decision. By
establishing a register of damages, the UN is trying to sell a willingness
to "compensate" people for the lands confiscated for the Wall as a
substitute for actually stopping and dismantling the Wall. This decision
must be understood as an attempt to legitimize the theft and dispossession
that is the whole reason for the existence of the Apartheid Wall in the
first place, and gives the illusion of legality to an illegal reality.

Therefore, the Palestinian Grassroots Anti-Apartheid Wall Campaign, which
represents a number of major Palestinian civil society organizations and
over 50 regional popular committees, is issuing an immediate call for action
in order to protest this attempt by the UN to avoid its responsibility to
enforce implementation of the ICJ ruling. WE DEMAND THAT THE UNITED NATIONS
FINALLY TAKE SERIOUSLY ITS OBLIGATION TO FORCE ISRAEL TO BE ACCOUNTABLE FOR
ITS VIOLATIONS OF INTERNATIONAL LAW, BY ENFORCING THE ICJ RULING AGAINST THE
APARTHEID WALL, THE SETTLEMENT POLICY, AND THE OCCUPATION IN ITS ENTIRETY!

We call on all organizations and individuals dedicated to social justice
take action now to make the UN hear this call. Send letters of protest to
Kofi Annan and other UN officials, to the European Union, to the political
representatives in your country, to the press-anywhere you can. THIS ATTEMPT
TO UNDERMINE THE ICJ RULING, AND TO ALLOW THE CRIMINAL APARTHEID WALL TO
REMAIN AND CONTINUE, MUST BE EXPOSED AND OPPOSED IMMEDIATELY!

The Palestinian Grassroots Anti-Apartheid Wall Campaign Demands: Stop
Punishing Those Who Are Trying to Expose Israel's Crimes, Start Holding
Israel Accountable through Boycott, Divestment, and Sanctions Campaigns

The Palestinian Grassroots Anti-Apartheid Wall Campaign, which represents a
number of major Palestinian civil society organizations and over 50 regional
popular committees, wishes to protest in the strongest possible terms the
arrest of two members of the Palestine 33 Committee in France. We call upon
all other organizations and individuals dedicated to supporting the
Palestinian struggle against Israeli Occupation to join us in offering our
support to Palestine 33 and in condemning this attempt to stifle their
legitimate protest.

The two members of Palestine 33 are charged with placing stickers on
products that were made in Israel in a supermarket in Bordeaux. The stickers
call upon consumers to boycott Israeli products. The two members of the
group, Sakina and Philippe Arnaud, were handcuffed, placed in custody, and
searched as a result of this "crime," and charged with causing "severe
damage" to the supermarket. They even had their computers confiscated from
their homes by the police for further analysis.

Palestine 33 is one of many groups throughout France, Europe, and the world
involved in a boycott campaign against products made in Israel, as a protest
against Israel's innumerable violations of international law. As a
Palestinian Campaign involved in the struggle against Israeli Occupation and
Apartheid, we know that such boycott campaigns are the only way to force the
international community to act, in order to hold Israel accountable for its
crimes.

Palestine 33 has declared that they and other groups want to inform
consumers of the facts about products made in Israel. They note that the
International Court of Justice has declared Israel to be in violation of
international law in its building of the Apartheid Wall, as well as in its
settlement and occupation policies; that products produced in Israel
settlements-settlements that are all illegal under international law-have
been banned by the EU; and that the European Parliament has asked the EU to
suspend its trade association deal as long as Israel is in violation of
international law. The call for a boycott is simply an attempt to provide
pressure in order to end Israel's violations and hold it accountable for its
crimes.

But instead of joining to condemn Israel for its crimes against the
Palestinian people, the French government has shown itself willing to remain
complicit with these crimes. It claims that those who are merely trying to
expose and protest Israel's crimes are the "criminals." By arresting
activists for doing no more than informing the public about products made by
Israeli Apartheid and calling upon them to boycott these products, the
French government shows itself willing to make any act of protest a crime.
Further, it shows that it is more ready to continue to defend Israel's
crimes against the people of Palestine than it is to listen to its own
citizens, who are calling for an end to support for these crimes and
demanding that Israel at last be held accountable.

We at the Palestinian Grassroots Anti-Apartheid Wall Campaign pledge our
support to Palestine 33 and condemn in the strongest possible terms these
attempts to silence and intimidate those who continue to protest against
Israel's crimes. We express our appreciation for the grassroots support of
groups in France, and throughout the world, who are initiating boycott,
divestment, and sanctions campaigns against Israeli Apartheid and
Occupation. It is upon this grassroots support that the people of Palestine
can draw for our struggle.

We loudly call upon all organizations and individuals throughout the world
dedicated to justice in Palestine, and to social justice in any form, to
protest against this attempt by the French government to try to stop the
boycott campaign led by groups such as Palestine 33. As the struggle against
Apartheid in South Africa taught us, such efforts to stifle or shut down
such campaigns can never succeed, just as apartheid can never last, if we
join together in the struggle to expose Israel's crimes, demand
accountability for these crimes, and bring them to an end.
